Parents are the natural guardians of their minor children and are entrusted to make healthcare decisions for their children as a matter of law. This parental authority was derived from the constitutional right to privacy regarding family matters, common law rule, and a general presumption that parents or guardians will act in the best interest of their child. In certain instances, other individuals may be required to make healthcare decisions on behalf of the minor patient either when duly appointed by a parent or by court order. Join us as we discuss the rights of minors and parents in medical decision making, and address legal and ethical challenges in determining consent for minors.

Target Audience

Physicians, Psychologists, Physician Assistants, Nurse Practitioners, Nurses, Occupational Therapists,  Respiratory Therapists, Radiology Technicians, Social Workers, Clinical Chaplains, Medical Students, and other interested healthcare professionals.

Learning Objectives

  • Conform to provisions of Florida Statute 765 regarding healthcare surrogates for minors and comply with BHSF policies regarding legal decision makers for the minor patient.
  • Identify the various circumstances where a appropriate legal decision-makers must be located, and take the steps required to obtain consent for treatment of the minor patient.
  • Recognize key ethical and legal challenges in identifying appropriate legal decision makers and obtaining consent to provide medical care to minors.
